Fair Use & Text and Data Mining (TDM) Compliance Checklist

This document outlines LingoFlix's compliance with fair use principles and text and data mining best practices. This checklist is reviewed annually to ensure ongoing compliance.

1. Purpose and Character of Use

• Educational Purpose: LingoFlix uses movie scripts exclusively for educational purposes to help users learn English phrasal verbs and slang.
• Transformative Use: The original content is transformed into structured language exercises, not displayed in its original form.
• Non-Commercial Priority: Public domain and Creative Commons content is prioritized over commercially licensed content.
• Limited Scope: Only specific language features are extracted, not the creative expression of the original work.

2. Nature of Copyrighted Work

• Published Works: LingoFlix only uses publicly available, already published scripts.
• Factual Elements: The system extracts factual language elements (phrasal verbs, slang) rather than creative elements.
• Opt-Out Respected: Sources that explicitly opt-out via robots.txt or meta tags are excluded from processing.

3. Amount and Substantiality

• Minimal Extraction: Only individual sentences containing target language features are extracted.
• No Full Scripts: Complete scripts are never displayed to users.
• Ephemeral Storage: Raw script text is kept for ≤24 hours and then purged.
• Tokenized Storage: Only tokenized JSON and embeddings persist beyond 24 hours.

4. Effect on Potential Market

• No Market Substitution: The extracted exercises cannot substitute for the original works.
• No Redistribution: Original script text is not redistributed in any form.
• Attribution: Creative Commons sources are properly attributed.
• Takedown Process: A clear takedown process is provided for rights holders.

5. Technical Safeguards

• Automated Purging: Raw script files are automatically purged after 24 hours.
• CI Verification: Build process verifies no expressive text (>20 contiguous chars) is included.
• License Registry: All sources are tracked with their legal basis in a machine-readable registry.
• Audit Logging: All processing activities are logged for compliance verification.
